These terms govern your use of the Dynaryx website and simulation platform. By creating an account, requesting a demo, or otherwise using the service, you agree to them.

The service

Dynaryx provides cloud-based engineering simulation, including finite element analysis, computational fluid dynamics and thermal analysis, together with automated engineering reports, optimisation suggestions and fabrication drawings. Parts of the service are offered on a beta basis and may change, break or be withdrawn.

Eligibility and accounts

You must be at least 16 years old and able to enter a binding contract. If you use the service on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms.

You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for all activity that takes place under your account. Tell us promptly if you suspect unauthorised access.

Acceptable use

You agree not to:

  • Use the service in breach of any applicable law, export control or sanctions regime.
  • Upload content you do not have the right to upload, or that infringes someone else's intellectual property or confidentiality obligations.
  • Reverse engineer, decompile or attempt to extract the source code or models behind the platform, except where that restriction is prohibited by law.
  • Interfere with the platform's operation, circumvent usage limits or access controls, or run automated processes that place an unreasonable load on our infrastructure.
  • Resell, sublicense or provide the service to third parties as a bureau service without our written agreement.

Your content

You retain all ownership of the CAD files, geometry, materials data and other content you upload, and of the reports and drawings generated from them. You grant us a limited licence to host, process, transmit and display that content solely to operate and support the service for you.

You are responsible for having the rights necessary to upload your content and for ensuring that doing so does not breach any confidentiality obligation you owe to a third party.

Our intellectual property

The platform, its software, solvers, models, interfaces, documentation, branding and the content of this website are owned by Dynaryx or its licensors and are protected by intellectual property law. Subject to these terms and to payment of any applicable fees, we grant you a non-exclusive, non-transferable, revocable right to use the service for your internal engineering purposes.

Engineering results: important limitation

Simulation results, optimisation recommendations, code references, engineering reports and fabrication drawings produced by the platform are engineering aids. They are not a substitute for the judgement, review and sign-off of a qualified engineer.

Accuracy depends on the inputs you provide, meaning geometry, materials, boundary conditions, load cases and assumptions, and on the limits of the underlying numerical methods. You are responsible for verifying and validating every result before relying on it, and for obtaining any professional certification, stamp or regulatory approval your project requires. Dynaryx does not provide professional engineering services and does not certify designs.

Plans, fees and billing

Paid plans are billed in advance on the cycle shown at purchase and renew automatically until cancelled. Fees are exclusive of taxes unless stated otherwise, and you are responsible for any applicable taxes.

You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. We may change pricing on notice, with changes taking effect from your next renewal. Free-tier and beta access may be limited, changed or withdrawn at any time.

Availability

We aim to keep the service available and performant, but we do not guarantee uninterrupted access. Maintenance, third-party outages, solver queue times and factors outside our control may affect availability. Unless we have signed a separate service level agreement with you, the service is provided without an availability commitment.

Third-party services

The service integrates third-party components, including cloud infrastructure, payment processing and demo scheduling. Your use of those components may be subject to their own terms, and we are not responsible for their acts or omissions.

Disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available", and we disclaim all implied warranties including merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these terms excludes liability that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, Dynaryx will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, data, goodwill, or for the cost of remedial engineering, rework, scrap, recall or project delay, arising out of or in connection with the service.

Our total aggregate liability arising out of or in connection with these terms will not exceed the greater of the fees you paid to Dynaryx in the twelve months before the event giving rise to the claim, or one hundred US dollars.

Indemnity

You will indemnify Dynaryx against claims, losses and reasonable costs arising from your content, your use of the service in breach of these terms, or your breach of applicable law.

Suspension and termination

We may suspend or terminate access if you materially breach these terms, if required by law, or if your use poses a security or stability risk. You may stop using the service and close your account at any time. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limits and indemnities, will survive.

Changes to these terms

We may update these terms as the service develops. We will update the date at the top of this page, and where changes are material we will give reasonable notice. Continuing to use the service after changes take effect means you accept the updated terms.
